Assault

assault

 

A defendant is liable for assault if his/her actions:

 

1) intended to cause a reasonable apprehension, harmful or offensive contact;  with another person; and

 

2) that person is actually put in reasonable imminent apprehension. 

 

Examples of Assault:

 

  • Holding a knife to a victim, threatening to stab them
  • Pointing a toy guy at a victim who did not know the gun was a toy and threatening them. 
  • Throwing a rock at someone

note:  words alone cannot create a reasonable apprehension of imminent harmful or offensive contact.
